(Oral) Today, at the very outset, the learned counsel for the petitioner submits that he may be permitted to withdraw the instant petition. He has however, submitted that since the petitioner has been behind bars for the last about 1 year and 10 months and no PW has been examined till date, the trial Court may be directed to expedite the conclusion of trial. In view of the aforesaid request, the present petition is dismissed as withdrawn. However, keeping in view the custody of the petitioner which is stated to be 1 year and 10 months and the fact that no PW has been examined although 18 PWs have been cited, as has also been affirmed by learned State counsel, the trial Court is directed to take MOHAN SINGH 2021.12.03 13:43 I attest to the accuracy and integrity of this document

- 2 - CRM-M-28723-2020 (O&M) necessary steps for expediting the conclusion of trial subject, of course to adherence of all the safeguards as are required to be observed on account of spread of pandemic Covid-19. The Trial Court may make a schedule in advance for recording prosecution evidence and fix 4 or 5 dates in advance or even more during the next fortnight and after examining the list of witnesses, the unexamined PWs be summoned by allocating different dates for their presence. Summons for all the dates fixed in advance be issued in one go and their service be duly monitored.
