Mr. Ritesh Tomar, Advocate, for the petitioner Mr. Abhinash Jain, DAG, Haryana KULDEEP TIWARI,J. (ORAL) 1.

The petitioner who was on regular bail in case FIR No. 008 dated 8.1.2020, under Section 25 of Arms Act, and under Sections 120-B, 34, 341, 379B and 506 IPC, registered at Police Station Hodal, District Palwal, could not cause appearance on dated 10.4.2024, and an application for exemption was preferred which was declined by the learned trial court concerned, and consequently, his bail was canceled, and bail bonds were forfeited to the State.

Though, the learned counsel for the petitioner failed to point out any illegality or perversity in the order declining the exemption application, passed by the learned trial court concerned, however, he submits that the petitioner never intend to avoid appearance before the learned trial court concerned, and is ready, and willing to join the trial in case, adequate protection is granted.

Per contra, learned State counsel opposes the grant of relief DALBIR SINGH TIWANA 2024.05.30 22:32 I attest to the accuracy and integrity of this document

CRM-M-28481-2024 (supra), to the present petitioner.

This Court has heard the learned counsel for both the parties concerned, and has gone through the entire case file. 5.

The prayer made by the learned counsel for the petitioner is accepted. The petitioner is directed to surrender before the learned trial Court concerned within 10 days from today.

In case the petitioner surrenders before the learned trial Court concerned, within a stipulated time and furnishes fresh bail and surety bonds, the same shall be accepted by the learned trial Court concerned, however, subject to its satisfaction, and the petitioner shall be released on regular bail.

In the meanwhile, the arrest of the petitioner shall remain stayed.

However, in case, the petitioner fails to appear before the learned trial Court concerned within 10 days from today and furnish bail and surety bonds, the protection granted hereinabove, qua his arrest shall ipso facto vacated, without any further reference to this Court. 9.

Disposed of accordingly.
