Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to release the remaining retiral benefits of the petitioner amounting to Rs.13,22,262/- towards gratuity and leave encashment along with interest @ 12% per annum to be calculated from the date of retirement i.e. 31.01.2024, till the date of final realization.

Learned counsel for the petitioner, at the very outset, confines his prayer for deciding representation dated 02.05.2024 (Annexure P-4). He submits that at this stage, petitioner would be satisfied, if the said representation is decided by passing a speaking order within a time bound frame.

Mr. Rajesh Sehgal, Addl. A.G., Punjab, accepts notice on behalf of respondents No.1 and 2. On the asking of the Court Mr. Vipul Jindal, Advocate, who is on the panel of Department of Local Government, Punjab, has accepted notice on behalf of respondents No.3 and 4 and have no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.3 to decide representation dated 02.05.2024 (Annexure P-4), expeditiously submitted by the petitioner by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
