JASWANT SINGH, J (ORAL) The petitioner was working as Beldar with the Irrigation Department, Punjab (Field Cadre) and posted at Ranjit Sagar Dam Shahpurkandi. On completion of the works at Ranjit Sagar Dam, he was, vide order dated 14.6.2013 (P.10) along with other workers transferred and posted in the office of Water Irrigation Area, Ferozepur against a vacant post.
The petitioner, admittedly, being a resident of Shahpurkandi, has approached this Court by filing the present petition impugning his transfer and posting out of Shahpurkandi vide impugned order (P.10).
Upon notice, a reply has been filed stating that initially, the petitioner was engaged as Beldar on daily wage basis, however, his services were regularized in terms of Regularization Policy and thereby being a regular employee he was liable to be transferred anywhere in the office of the Department of Irrigation.
CWP No.14680 of 2013 #2# Even otherwise, it is borne out from the record that on completion of the works at Ranjit Sagar Dam in the year 2001, most of the categories of workmen had been declared surplus and today are litigating for their re-adjustment and absorption in various Departments.
Heard learned counsel for the parties and perused the paper book.
It is not in dispute that the petitioner in pursuance of the order had joined his place of posting at Ferozepur and is working as such.
In view of the fact that the transfer is a incidence of service, no interference is called for.
Dismissed.
