Mr. Ramesh Hooda, Advocate for the petitioner. **** SANJEEV PRAKASH SHARMA, J.(Oral) That the petitioner by way of this petition assails the order 04.05.2023 whereby interim maintenance has been granted to the respondentwife of Rs.5,000/- per month. Learned counsel submits that while passing an order for interim maintenance, the Court should have given a finding with regard to the reasons as to why the respondent has left the house of the petitioner. In the opinion of this Court, such course need not be adopted by the Courts at this stage of passing orders for interim maintenance. The only aspects which are required to be looked into are whether prima facie application under section 125 Cr.P.C. has been made out or not, and whether the husband has refused to provide for his wife and children. In the present case, this Court finds that the learned Court below has examined all the aspects as above, and reaches to the conclusion that the minimum amount of Rs.5,000/- should be paid as interim maintenance to the wife.
