***** CM-14377-CWP-2019 For the reasons mentioned in the application, the same is allowed. Delay of 68 days in refiling is condoned. RA-CW-390-2019 Learned counsel submits that during the pendency of the matter, the applicant/ petitioner was appointed as Programmer, a post which has no promotional avenue, while his claim being for appointment as Lecturer still subsists, for which liberty in the order dated 20.05.2019 itself had been granted to get the present petition revived.

Learned State is unable to offer any justifiable resistance to the prayer made, particularly in view of the fact that it was in the absence of the counsel for the petitioner, that the aforesaid order had been passed. Having heard learned counsel for the parties, the present application is allowed and the main case is ordered to be listed on 19.10.2024.
