Considering the recovery, no independent witness to the recovery was there and there being no other FIR against him, pre-arrest bail is granted to the petitioner subject to his joining investigation within 2 weeks. He shall be bound by the conditions under Section 438(2) Cr.P.C. The petition stands disposed of.

However, it is clarified that in case the petitioner fails to join the investigation within 2 weeks, the State would be at liberty to file an application for re-calling of the order.
