At the outset, learned counsel appearing for the Bank submits that the upfront amount due to the bank has been paid under the OTS scheme. According to him, petition is, thus, rendered infructuous. In view of statement made by counsel for the respondents-Bank, present petition is dismissed as having been rendered infructuous. Petitioner shall, however, be at liberty to avail appropriate remedy, in case any cause of action survives.
