RAMENDRA JAIN, J. (ORAL) Through this revision challenge has been laid to the order dated 21.03.2018 of the trial Court whereby the application of the petitioner for release of his passport was dismissed.

Learned counsel for the petitioner inter alia contends that the parties have compromised the matter. Consequently, the petitioner has filed CRM-M-15644-2016, for quashing FIR No 248 of 2016, under Sections 406, 409, 420, 467, 468, 471, 201 and 120-B IPC, Police Station Butana, District Karnal. In the said petition, report of the concerned Magistrate, has also been received, certifying that the compromise effected between the parties is genuine. The next date of hearing in the said petition is 06.09.2018, therefore, now the passport of the petitioner is no more required to be kept in judicial custody.

On the other hand learned State counsel opposes the prayer for release of passport of the petitioner, till the quashing of FIR in question. Rishu Kataria 2018.08.08 10:32 I attest to the accuracy and authenticity of this document

CRR-1224-2018 -2Having given considerable thoughts to the submissions made by learned counsel for the parties, I find merit in the instant revision, in view of the un-disputed fact that the petitioner has filed CRM-M-156442016, for quashing of aforesaid FIR, in which his passport was kept in judicial record. The learned Magistrate, concerned has verified the veracity of compromise between the petitioner and complainant. In view of the above factual aspect of the case, the instant revision is allowed and the trial Court is directed to release the passport of the petitioner against proper receipt and identification, in accordance with law.
