Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to release the retiral benefits including Leave Encashment and Death-cum-Retirement Gratuity to the petitioner along with interest @ 18% per annum from the date of retirement till its actual payment. Further prayer has been made to direct respondents No. 2 to 4 to decide the representation dated 10.12.2025 (Annexure P-2) within a time bound manner as the same has not been decided till today.

Learned counsel for the petitioner submits that he would be satisfied if the representation dated 10.12.2025 (Annexure P-2) of the MOHD YAKUB 2026.05.04 18:00 I attest to the accuracy and authenticity of this document Punjab & Haryana High Court, Chandigarh.
CWP-13732-2026 petitioner is decided by respondents No.3 and 4 by passing a speaking order in a time bound manner.

Learned State counsel as well as learned counsel for respondents No.2 to 5, appearing on advance notice, submits that they have no objection, in case a direction is issued to respondents No.3 and 4 for time-bound consideration and decision of the representation dated 10.12.2025 (Annexure P-2) of the petitioner by passing a speaking order.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, the respondents No.3 and 4 are directed to consider the representation dated 10.12.2025 (Annexure P-2) of the petitioner and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondents No.3 and 4.
