(Oral) The present petition has been filed under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioner, in case FIR No. 114, dated 15.08.2020, under Sections 406, 420 IPC, Section 13 of the Punjab Travel Professionals (Regulation) Act, 2014 and Section 24 of t he Emigration Act, 1983, registered at Police Station Rahon, District SBS Nagar. Learned counsel for the petitioner has reiterated the submissions made by him on the previous dates that the petitioner was innocent and he had not received any amount, much less, Rs. 18.00 lakhs from the complainant on the pretext of sending his son abroad. Learned State counsel while referring to the reply so filed by the State by way of affidavit of Raj Kumar, PPS, DSP, Sub-Division SBS Nagar, District SBS Nagar, Punjab, has invited the attention of this Court to para 5 of the same and submitted that during investigation it has come to the JAWALA RAM 2021.02.23 16:24 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-29064-2020 - 2 - fore that various amounts were withdrawn by the complainant and his brother and thereafter, handed over to the petitioner. It has also been submitted that the petitioner is a habitual offender and a man of criminal antecedents, as he is involved in one other case of similar nature, wherein, he had duped another person of Rs. 25.00 lakhs on the pretext of sending him aboard. The learned State has further submitted that the petitioner is also involved in a case under the NDPS Act.

Heard.

In the circumstances, keeping in view the nature and gravity of allegations levelled against the petitioner as well as keeping in view his criminal antecedents, no ground is made out to extend the extraordinary concession of anticipatory bail to the petitioner. Petition stands dismissed accordingly.
