Mr. Vikas Singh, Advocate, for the petitioner. Mr. Arvind Rajotia, Advocate, for respondent No.1. **** Rajan Gupta, J. (Oral) Petitioner in the present petition seeks a writ in the nature of mandamus to allow the petitioner to sell the stocks lying in the godowns of respondent No.2.
While claim of the petitioner-corporation is that the Bank is creating hurdle in sale of stocks lying in godowns of respondent No.2, learned counsel appearing for Punjab National Bank-respondent No.1 submits that the said stocks are pledged with the Bank and are in possession of agent appointed by it.
It appears that the disputed questions of facts are involved. Same cannot be decided in exercise of writ jurisdiction of this court. Petition is, thus, hereby dismissed with liberty to the petitioner to avail alternative remedy, if so advised.
