***** ARCHANA PURI, J. (Oral) Report from the Mediation and Conciliation Centre received. As per the same, the matter has been amicably settled between the parties. The settlement/agreement has been placed on record. The genuineness of the settlement/agreement, is admitted by both the counsel, present in the court today. The FAO was filed at the instance of the widow and the minor son of the deceased, Kuldeep Singh, who died in a motor vehicular accident, which took place on 22/23.06.2004.
On appraisal of the evidence brought on record, the compensation awarded by learned Tribunal, was to the extent of Rs.6,35,000/- along with the interest at the rate of 9% per annum, from the SONU 2026.03.11 08:59 I attest to the accuracy and authenticity of this document
FAO-1387-2008 (O&M) date of filing of the petition, till realization. Being aggrieved, the appellants have filed the present appeal.
However, the matter has been amicably settled before the Mediation and Conciliation Centre. As per the settlement/agreement, the Insurance Company, has agreed to pay a sum of Rs.9,50,000/-, over and above the amount already awarded by learned Tribunal, within a period of 45 days from the date of signing of the agreement i.e. 05.03.2026. Considering the settlement, so reached, the present appeal is hereby allowed and the Insurance Company, is directed to pay an amount of Rs.9,50,000/- to the appellants, within the period, as mentioned in the settlement/agreement. The aforesaid amount shall be paid to appellant No.1, as per Clause 7 of the settlement/agreement.
In the eventuality of default, the Insurance Company shall be liable to pay a penal interest at the rate of 8%, after the expiry of 45 days, till realization.
