**** MANJARI NEHRU KAUL , J. (Oral) The present petition has been filed under Section 482 Cr.P.C., for quashing of FIR No. 102, dated 04.04.2019, under Sections 323, 348, 506 IPC, registered at P.S. Division No.5, District Ludhiana. Pursuant to order dated 23rd September, 2019, status report by way of affidavit dated 27th September, 2019 of Richa Rani, S.I., SHO, P.S. Div. No.5, Ludhiana, on behalf of the State, has been filed in Court today. The same is taken on record, subject to all just exceptions. Office to tag the same at the appropriate place. A copy thereof has been handed over to the learned counsel for the petitioner.

As per the status report filed by the State, a compromise has been arrived at between the parties, as a result of which, a cancellation report has been prepared on 18th August, 2019 by the SHO, P.S. Div. No.5, Ludhiana. The relevant para of the status report is as under:- "3.

That on the basis of this compromise the police has cancelled this case and cancellation report has been JAWALA RAM 2019.09.30 11:36 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-26368-2019 - 2 - prepared on 18/08/2019 by the SHO, P.S. Div. No. 5, Ludhiana. So the petition filed by the petitioner has become infructuous. There is no merit in this petition and the same may kindly be dismissed in the interest of justice. This is brought to the notice of this Hon'ble Court."

In view thereof, learned counsel for the petitioner submits that he may be allowed to withdraw the instant petition with liberty to approach this Court again in case something survives therein.
