Jaswant Singh,J(Oral) Petitioner nos. 1 and 2 are working as SS Mistress while petitioner no.3 is working as Punjabi Mistress in Education Department,Punjab. They were selected in the Sports(General)Category on 28.6.2008. In the present petition the grievance raised by them is that private respondents 3 to 5, who were lower in merit than petitioners were given appointments earlier whereas petitioners were offered appointments after a delay of two years and thus they were made junior to private respondents 3 to 5.

Accordingly, relief of notional benefit of pay fixation to petitioners by giving benefit of annual increments was sought so as to bring them at par with their juniors. Reliance was placed on decisions of this Court in CWP 5779/2014 decided on 9.9.2015 (Azad Parvinder Singh v State of Punjab and others); and CWP10859/2007 decided on4.8.2008 (Karamjit Singh v State of Punjab and others) wherein similar relief was granted to petitioners in aforesaid two writ petitions. Upon notice, reply by way of affidavit dated 19.1.2015 of Rajinder Parshad Joshi 2017.02.

CWP 1234 of 2014 (SE)Punjab has been filed wherein it is stated that after considering the claim of the petitioners as set out in the present petition, necessary relief of deemed date of appointment (December 2006) in Master Cadre i.e. from the date their juniors were given appointment order with notional pay fixation benefit and seniority on the basis of petitioners' ranking in the selection list has been granted. A copy of the order dated 18.7.2014 passed in this regard has been appended with the affidavit as Annexure R-1. At the time of hearing,learned counsel for the petitioners, on instructions states that the present writ petition has become infructuous. Dismissed as having become infructuous.
