Present third petition has been filed praying for the grant of regular bail to the petitioner in case bearing FIR No.19, dated 06.03.2025, under Section 22 of NDPS Act and Section 223 of BNS (Sections 29 & 25 of NDPS Act added later on), registered at Police Station Sadar Jalalabad, District Fazilka, Punjab.

Succinctly, the facts of the case are that the police party while on patrolling on 06.03.2025 near the pakki nehar at the triangular point of village Mastu Wala, they saw one motorcycle coming from the side of

CRM-M No.25401 of 2026 (O&M) -2village Mastu Wala, which was being driven by a young man and one female was sitting on the pillion seat. The police party signalled the rider to stop the motorcycle, however, he got perplexed and tried to fled away from the spot. However, with the help of the police officials, both were apprehended along with the motorcycle. On asking, the rider of the motorcycle disclosed his name to be Sumer Singh @ Shambu, whereas the women sitting pillion, disclosed her name to be Jeeto Bai, i.e. the petitioner. They were suspected to be carrying some contraband and thus, their personal search as well as the search of motorcycle was conducted.

On conducting the search of the motorcycle, a black coloured polythene bag on the fuel tank of the motorcycle was recovered and further on conducting the search of the polythene bag, 50 strips of intoxicant tablets, i.e. total 2000 tablets containing Tramadol Hydrochloride and 11 boxes of intoxicant capsules and each box having 10 strips, thus, in total 1100 capsules brand Pregabalin were recovered from the same. They failed to produce any licence regarding the conscious possession of the same, thus, the FIR was registered and both were arrested on the spot. On registration of the FIR, the investigation commenced. The samples taken were sent to the FSL. On completion of the investigation, the challan was presented and on framing of charges, the trial commenced.

The petitioner approached the Court of learned Judge, Special Court, Fazilka, praying for the grant of regular bail. However, after hearing both the sides and finding no merit in the same, the learned Judge, Special Court, Fazilka, dismissed the bail application filed by the petitioner vide order dated 31.05.2025.

CRM-M No.25401 of 2026 (O&M) -362629-2025 and CRM-M-10976-2026, however the same were dismissed as withdrawn vide orders dated 20.11.2025 and 10.03.2026, respectively. Hence being aggrieved, the petitioner is again before this Court by way of filing the present third petition praying for the grant of regular bail. 3.

Learned counsel for the petitioner has submitted that the petitioner has been falsely implicated in the present case. She, at the outset, prays for the grant of regular bail to the petitioner on the basis of parity with that of the co-accused, namely, Sumer Singh @ Shambu. She has drawn the attention of this Court to the order dated 22.04.2026 passed in CRM-M19648-2026, whereby, co-accused, namely, Sumer Singh @ Shambu, has been granted the concession of regular bail by this Court. She submits that on the basis of the parity, the petitioner deserves to be granted bail as the case of the petitioner is similar to that of the said co-accused, who has already been granted bail by this Court vide order dated 22.04.2026. 4.

Learned State counsel has endorsed the factum of grant of bail to the co-accused of the petitioner as stated above and has not denied that the petitioner is at par with the co-accused, namely, Sumer Singh @ Shambu. He has produced custody certificate of the petitioner today in the Court, which is taken on record.

After hearing learned counsel for the parties and perusing the record, it is deciphered that the petitioner was arrested in this case on 06.03.2025. Co-accused, namely, Sumer Singh @ Shambu is on bail and as stated before this Court, case of the petitioner is at par with that of the coaccused. Custody certificate of the petitioner shows that the petitioner has

CRM-M No.25401 of 2026 (O&M) -4suffered incarceration of 01 year, 02 months & 22 days as on 02.06.2026. It further reflects that the petitioner is not involved in any other case. 7.

The veracity of the allegations would be assessed only after the conclusion of the trial and on the appreciation of evidence to be led by both the parties before the trial Court. The trial of the case will take sufficient long time. Keeping in view the arguments raised by both the sides and perusing the record, this Court is of the opinion that learned counsel for the petitioner succeed in making out a case for grant of regular bail to the petitioner on the basis of parity.

Accordingly, the present petition is allowed and the petitioner is ordered to be released on bail on her furnishing bail/surety bonds to the satisfaction of the concerned trial Court/Duty Magistrate. 9.

Nothing said herein shall be treated as an expression of opinion on the merits of the case.
