(ORAL) On 6.6.2019, the following order was passed: - "As per the allegations levelled by the police, recovery of 250 Kg of Lahan have been recovered from the pucca khal, a public place, and thus, the very element of conscious possession, being a debatable issue and recovery having already been effected, the petitioner is entitled to the relief of interim bail.

Notice of motion for 05.08.2019.

Meanwhile, in the event of arrest, the petitioner be released on interim bail to the satisfaction of arresting/Investigating Officer. The petitioner shall, however, join investigation as and when called for to do so and he shall also abide by the conditions as envisaged under Section 438 (2) Cr.P.C."

Learned counsel for the State, on instructions from SI Baljeet Singh, has submitted that petitioner is a habitual offender involved in as many as six more cases.

In view of aforesaid, no ground is made out to grant the concession of pre-arrest bail to the petitioner. The petition is dismissed.
