RAJESH BHARDWAJ, J. (ORAL) Matter has been taken up through video conferencing via Webex facility in the light of the Pandemic Covid-19 situation and as per instructions.

CRM-29517-2021 For the reasons mentioned in the application, the same is allowed. Annexure P-10 is taken on record.

CRM-M-34312-2021 Instant petition has been filed under Section 438 Cr.P.C. praying for grant of anticipatory bail to the petitioners in case FIR No.256, dated 25.09.2013, under Sections 406/498 A IPC, registered at Police Station Chherretta, District Amritsar, wherein they have wrongly been declared proclaimed offender.

Learned counsel for the petitioners has placed on record the tickets of the petitioners which would show that they are boarding their flight on 22.10.2021 and would land in India on 23.10.2021. Learned MEENU 2021.09.13 17:25 I attest to the accuracy and authenticity of this document chandigarh

On the asking of the Court, Mr.M.S.Nagra, Assistant Advocate General, Punjab, accepts notice on behalf of the State. Heard.

In view of the facts and circumstances of the case, the present petition is disposed of with a direction to the petitioners to appear before the concerned Court on 26.10.2021 and move an application, which would be taken into consideration by the Court concerned who will decide the same in accordance with law.

In the meantime, the petitioners would have protection from their arrest from 23.10.2021 (the date when they will land in India) itself for a period of 15 days enabling them to approach the concerned Court. September 13, 2021 ( RAJESH BHARDWAJ ) meenuss JUDGE 1.
