RAKESH KUMAR JAIN, J (ORAL) On the last date of hearing i.e 21.04.2016, the following order was passed by this Court:

"State counsel is directed to provide the entire details of the person namely Manjinder Singh Aulakh @ Bittu Aulakh who is alleged to have been provided police security and a red beacon on his Pajero vehicle No. PB02-0002 and has also been arrested in an NDPS case. The affidavit of Home Secretary, Punjab be filed in this regard on or before the next date of hearing.

Adjourned to 12.05.2016."

Pursuant to the aforesaid order, an affidavit dated 11.05.2016 of Sh. Jagpal Singh Sandhu, IAS, Addl. Chief Secretary to Government of Punjab, Department of Home Affairs and Justice filed today in court is taken on record. In this affidavit, it is averred that Manjinder Singh Aulakh @ Bittu Aulakh is son of Master Partap Singh, R/o Village Veirowal, P.S

CWP No.12395 of 2014 #2# Lopoke, District Amritsar Rural. He is involved in FIR No.101 dated 11.06.2012 U/ss 420 IPC, P.S Lopoke, District Amritsar Rural, FIR No.56 dated 15.05.2013 U/ss 379/411/473 IPC and Sections 21/22/25A/29 of NDPS Act 25 Arms Act P.S Banur, District Patiala and FIR No.109 dated 24.12.2013 U/ss 21/27/29/61/85 of NDPS Act, P.S Lambra, District Jalandhar Rural. It is also mentioned that no police protection or permission for red beacon has been given by the State of Punjab to said Manjinder Singh Aulakh @ Bittu Aulakh. Rather, it is submitted by learned State counsel that Manjinder Singh Aulakh @ Bittu Aulakh is presently in Jail.

In any case, if said Manjinder Singh Aulakh @ Bittu Aulakh is actually using red beacon on his Pajero bearing No.PB02-0002, the Home Secretary is directed to immediately impound the said vehicle. So far as the request of learned counsel for the petitioner for providing certified copies of all the affidavits and replies filed by the State Government in SLP (Civil) No.25237 of 2010 is concerned, the same can be obtained by the petitioner by filing appropriate application seeking certified copies of required documents of said case, which is alleged to have already been disposed of.

No other issue is left to be decided.

Petition stands disposed of.
