This is a civil writ petition filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing the order dated 13.12.2021 (Annexure P-8), whereby the claim of the petitioner has been rejected.

The petitioner approaches this Court for counting service rendered by him in a private institution from 16.11.1969 to 24.03.1977. Thereafter, she joined Government service on 29.11.1990. This Court allowed the petitioner to make a representation to the authorities for passing a speaking order and speaking order has been passed on 13.12.2021, wherein, the authorities have noticed that there is a gap of 13 years, 8 months and 4 days in joining Government service from the period of service rendered with the private institution and, therefore, the claim for counting the said service for pensionary benefits, has been denied. No ground has been raised as to how the said period can be counted after a long gap of 13 years, 8 months and 4 days. 4.

Keeping in view the above, the present petition is found to be wholly frivolous and abuse of process of Court. Accordingly, the same is dismissed with costs of Rs.10,000/- to be deposited with the High Court Legal Services Committee and to be recovered as arrears of land revenue, if the same is not deposited.
