The present petition has been filed for issuance of directions to respondents No.2 and 3, to look into the representation dated 13.05.2024 (Annexure P-4) and to nominate respondent No.4-Narinder Kaur as accused in case FIR No.0026 dated 02.05.2024 under Sections 323, 325 and 34 IPC, registered at Police Station Tibber, District Gurdaspur. It is submitted by learned counsel for the petitioner that relating to the occurrence in question, FIR was got registered, at the instance of the petitioner, copy whereof is Annexure P-1. Even though, the petitioner, in the same, had specifically mentioned about the presence of Narinder Kaur, at the spot of occurrence, while armed with iron pipe and she having given a hit on left thigh of the petitioner, with the iron pipe, but however, the police, VINEET GULATI 2024.06.04 15:58 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-29248-2024 -2with the purpose to help the accused persons, had concluded about Narinder Kaur, to have not participated in the fight in question. Relating to the same, learned counsel for the petitioner submits that representation was also given to SSP, Gurdaspur, to nominate Narinder Kaur, as one of the accused in the aforesaid FIR and the same was filed on 13.05.2024. However, no action has been taken, on the said representation also. Notice of motion.

Mr.Solomon Partap Singh, Asstt. Advocate General, Punjab, who is present in the Court, accepts notice on behalf of the respondent-State and assures about the decision on the representation, within a period of seven days from today onwards.

In view of the assurance given by learned State counsel, the present petition is disposed of, with the observations that concerned Senior Superintendent of Police, shall consider the representation (Annexure P-4) within a period of seven days and initiate appropriate action, if so called for.
