**** RAJ MOHAN SINGH, J. (Oral) The case has been taken up for hearing through videoconferencing. Petitioner seeks grant of anticipatory bail under Section 438 Cr.P.C in case bearing FIR No.117 dated 18.07.2020 registered under Sections 498-A, 406 IPC, at Police Station Sadar Gurdaspur, District Gurdaspur.

Notice of motion was issued on 25.09.2020 and arrest of the petitioner was stayed. Thereafter, matter was referred to Mediation and Conciliation Centre at Gurdaspur for striking an amicable resolution of dispute. Mediation proceedings could not fructify. Vide order dated 10.03.2021, petitioner was directed to join the investigation with interim bail.

Learned counsel for the petitioner submits that petitioner has joined the investigation and co-operated with the Investigating Officer.

CRM-M-29739-2020 Learned counsel for the complainant, however, opposed the bail on the ground that the complainant is still ready to live in the matrimonial house with the petitioner but the petitioner is not willing to perform his part of obligation. Learned counsel for the petitioner submits that father of the petitioner had expired and there was pointed suspicion about intake of some intoxicant substance at the instance of the present complainant and that was the reason for not fructifying the mediation proceedings.

Learned State counsel on instructions from ASI Kuldeep Singh admits the aforesaid fact and submits that the petitioner has joined the investigation on 14.03.2021 and his presence is no more required for further investigation in the case. Challan is yet to be presented.

In view of aforesaid factual position, the interim order dated 10.03.2021 is made absolute. Petitioner shall keep on joining the investigation as and when required to do so and he shall abide by the conditions as envisaged under Section 438(2) Cr.P.C.

Petition stands disposed of.
