Jaswant Singh,J(Oral) Sohan Lal-petitioner no.1 and Kala Singh-petitioner no.2, working as Foreman Refrigeration and Foreman Boiler Attendant Grade-II respectively, with respondent no.2-Milk Union filed the present petition seeking quashing of the orders dated 13.5.2016 (P-3 and P-4) qua petitioners whereby their pay had been reduced and recoveries effected without following any procedure of law. Further prayer was for a mandamus for implementation of the order dated 24.9.
2010 (P-1 and P-2) whereby their pay was so fixed, as stated in the order. At the time of hearing, learned counsel for respondent no.2 submits that present petition has become infructuous as both the impugned orders P-3 and P-4 have since been withdrawn and their pay has been restored. Copies of orders dated 29.8.2016 passed qua each of the petitioner have been produced and are taken on record as Mark-A and Mark-B, Rajinder Parshad Joshi 2016.09.
CWP 10774/2016 In view of the statement made by the counsel for respondent no.2 nothing more requires to be adjudicated in this petition and accordingly, present writ petition is dismissed as infructuous. Respondent no.2 shall be bound by its statement made through its counsel.
