(ORAL) The petitioner has assailed the order dated 30.06.2022 passed by the District Education Officer, Gurugram to the extent of ordering recovery of Rs.10,64,331/- excess amount paid to the petitioner from leave encashment. Admittedly, the amount towards leave encashment has already been paid during pendency of the present petition on 29.03.2023.

Learned counsel for the petitioner submits that the amounts under gratuity and commuted pension have not been released to the petitioner so far. The present petition is directed POONAM BHATT 2023.05.04 17:30 I attest the accuracy and authenticity of this order/judgment

2023:PHHC:061706 CWP No.16030 of 2022(O&M) -2only against the recovery from leave encashment and this writ petition has become infructuous qua that relief. However, petitioner would be at liberty to assail the in-action(if any) on behalf of the respondent-department in respect of non-releasing of gratuity and commuted pension in accordance with law. Disposed of.
