(The proceedings are being conducted through video conferencing, as per instructions) ******* G.S. SANDHAWALIA, J.(Oral) Present civil writ petition has been filed under Articles 226/227 of the Constitution of India seeking direction to respondent No.3 to allow the petitioner to work from home and allow the special casual leaves for the period of his treatment (23.06.2021 to 11.07.2021 and 14.07.2021 to 22.07.2021) and to consider his transfer request dated 15.07.2021 (Annexure P-11) on medical ground in a time bound manner, is sought. At the outset, counsel for the petitioner submits that he will only press the transfer request of petitioner dated 15.07.2021 (Annexure P11) on the medical ground in the present writ petition. The case of the petitioner is that he is working as Assistant Professor in Physics and presently posted at Govt. College for Women, Bahadurgarh, District Jhajjar and tested COVID-19 positive on 21.05.2021 SACHIN MEHTA 2021.08.23 18:54 I attest to the accuracy and authenticity of this document High Court, Chandigarh

CWP-16220-2021 -2and has also been infected by black fungus/mucormycosis and is very weak. It is his case that since he is resident of District Rohtak, he prayed for his transfer to Govt. College for Women, Rohtak so that he can perform his duty and also take treatment from P.G.I. Rohtak as it is very difficult for him to perform his duty daily by travelling to a distance of 50 Kms. It is further pointed out that his request has also been forwarded by the concerned quarter on 30.07.2021 with the request that some alternate faculty be provided in his place.

Notice of motion.

Ms. Kirti Singh, D.A.G. Haryana accepts notice on behalf of respondents.

Keeping in view the above facts and circumstances, this Court is of the opinion that reply of the respondents is not required in this case. Accordingly, directions are issued to respondent No.2 to decide the transfer request dated 15.07.2021 (Annexure P-11) of the petitioner within a period of two weeks from receipt of certified copy of this order. Keeping in view the background of the petitioner's illness, respondent No.2 is expected to take sympathetic consideration in the matter. ( G. S. SANDHAWALIA ) August 23, 2021 JUDGE Sachin M.
