The instant revision petition has been filed by a proprietary firm through its proprietor, namely, Kashmir Lal, who was convicted by the learned Magistrate concerned, under Section 138 of the Negotiable Instruments Act.

Today, the learned counsel appearing for the petitioner has made a statement before this Court that the demise of Kashmir Lal, proprietor of the petitioner-firm, has occurred, therefore, the instant petition stands abated.

The learned counsel appearing for the respondent No.2 has drawn attention of this Court towards an order made by this Court on 12.02.2018, whereby, it was agreed by the deceased proprietor of the petitioner-firm that he is ready and willing to, apart from the cheque DEVINDER YADAV 2023.12.15 09:22 I attest to the accuracy and authenticity of this order/judgment

CRR-4437-2017 2023:PHHC:158991 amount, give an additional amount of Rs.2 lacs to the respondent No.2 to settle the dispute.

Be that as it may, the respondent No.2 can seek redressal of his grievance through making an appropriate motion before the appropriate authority/court concerned.

In view of the statement made hereinabove by the learned counsel for the petitioner, the instant petition is dismissed, as having been rendered abated.
