(ORAL) Prayer in this petition is for grant of anticipatory bail in FIR No.341 dated 16.07.2019 under Sections 120-B, 323, 406, 420, 379-B IPC, registered at Police Station Shahabad, District Kurukshetra. While granting interim bail to the petitioner, following order was passed by this Court on 22.07.2022: - "This is the third petition, filed by the petitioner, seeking grant of anticipatory bail.
The first petition, bearing CRM-M-10450-2021, was
-2dismissed on merits on 23.08.2021 and the second petition, bearing CRM-M-37577-2021, was dismissed on 10.09.2021 by observing that there was no change of circumstances. Learned counsel for the petitioner submits that the new ground for filing the present petition is that the petitioner has entered into a valid compromise with complainant Amit Kumar. On the last date of hearing, learned State counsel has sought time to seek instructions from the Investigating Officer about the validity of the compromise.
Today, learned State counsel, on instructions from SHO/Inspector Davinder, submits that the complainant has effected compromise with two co-accused i.e. petitioner Priyanka alias Priya and Jasbir, who has already been granted the concession of bail by this Court.
Learned counsel for the complainant has also admitted to the factum of compromise entered into between the parties." Learned counsel for the petitioner submits that in pursuance of the aforesaid order, the petitioner has joined the investigation and is not required for any further investigation.
Learned State counsel, assisted by learned counsel for the complainant and on instructions from the Investigating Officer/SHO, Police Station Shahabad, District Kurukshetra, has not disputed the factual position and states that the petitioner is no more required for any further investigation. It is not disputed that the matter has been compromised between the parties.
-3In view of the above, this petition is allowed and the interim bail granted to the petitioner vide order dated 22.07.2022 is made absolute subject to the conditions envisaged under Section 438 (2) Cr.P.C.
