Mr.Atul Lakhanpal, learned senior counsel assisted by Ms.Bably Dahiya, Advocate appearing on behalf of petitioner submitted that grievance of petitioner in present writ petition is that while working as History Lecturer in Jain College Malerkotla, Dev Samaj College, Ambala City, DAV, College Guhla Chika and Punjabi University, Patiala vide order dated 22.08.2016 followed by charge-sheet dated 30.03.2017 was placed under suspension. As per rules, petitioner is entitled to 90% of subsistence allowance after the period of 06 months i.e. from 22.02.2017 but impugned order dated 15.05.2019 (Annexure P-7), thereafter, has been passed by SAVITA KADIAN 2019.07.16 14:22 I attest to the accuracy and integrity of this document High Court Chandigarh
CWP No.18046 of 2019 {2} Additional Chief Secretary to Govt. Haryana, School Education Department, Chandigarh increasing the subsistence allowance from 50% to 90% with immediate effect.
In view of the statement made by learned counsel for the petitioner and without going into the merit of the case or commenting thereon, present writ petition is disposed of with a direction to the respondent that in case, petitioner makes representation to Additional Chief Secretary to Govt. Haryana, School Education Department, Chandigarh as per prevalent rules applicable to her regarding increase of subsistence allowance after expiry of six months, same shall be decided within a period of one month from the date of receipt of certified copy of this order.
In case, claim of the petitioner is accepted, consequential benefits, if any, be released to her, in accordance with law and if the claim of the petitioner is not accepted, then a well reasoned and speaking order be passed and conveyed to the petitioner forthwith. In case, representation is not decided within aforementioned specified time, there shall be costs of Rs.50,000/- to be paid by the concerned officer to the petitioner.
