The petitioner through instant petitions under Articles 226/227 of the Constitution of India is seeking direction to respondent to permit her to continue to work as Assistant Professor.

The petitioner in the original petition made multiple prayers, however, during the course of hearing has confined her prayer to permit her to continue in view of her uninterrupted more than a decade service. 4.

The respondent has filed additional affidavit wherein conceded that petitioner is working as Assistant Professor in UIET. She is teaching Physics. There are six posts of Assistant Professors (Physics) in UIET. One post is lying vacant. The petitioner is working against vacant post of Assistant Professor.

Considering the factual position and keeping in mind order of Hon'ble Supreme Court in Hargurpratap Singh Vs. State of Punjab and others, (2007) 13 SCC 2,
this Court finds it appropriate to direct the respondent-University to permit the petitioner to continue to work as Assistant Professor till regular Assistant Professor (Physics) is appointed in UIET.
