(ORAL) The present petition has been filed by the petitioner under Section 439 Cr.P.C for grant of bail pending trial in case FIR No.119 dated 03.10.2013 registered under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985, at Police Station Kot Isse Khan, District Moga.

Short reply dated 11.08.2023 by way of affidavit of Ravinder Singh, PPS, Deputy Superintendent of Police, Dharamkot, District Moga, has been filed on behalf of the respondent-State. The same is taken on record.

Learned counsel for the State, being instructed by Mr. J Elanchezhian, SSP, Moga, who is present in Court, pursuant to the previous order dated 11.08.2023 passed by this Court, has submitted that there were VIRENDRA SINGH ADHIKARI 2023.09.11 14:59 I attest to the accuracy and authenticity of this document Punjab and Haryana High Court at Chandigarh

2023:PHHC:118018 CRM-M-29033-2023 -2total 16 prosecution witnesses in the present case and out of that, 07 witnesses have been produced before the Trail Court, 06 witnesses have been given up by the prosecution and 01 witness has since expired. Therefore, 02 more witnesses are required to be produced by the prosecution before the Trial Court. The said 02 witnesses will be produced before the Trial Court on the next date of hearing, i.e. 12.09.2023. These left out witnesses, as well as, any other person required as a witness shall be produced on the next date of hearing before the Trial Court. In view of the above, learned counsel for the petitioner seeks permission to withdraw the present petition.

Dismissed as withdrawn, as prayed for.
