(ORAL) In the present petition, the grievance being raised by the petitioner is that though the petitioner is entitled for stepping up of his pay equivalent to his junior namely Khushi Ram but the said benefit has not been extended to him, hence the respondents be directed to grant said benefit along with arrears and interest.
Learned counsel for the petitioner submits that the grievance raised in the present petition has already been raised through the legal notice dated 11.04.2023, copy of which has been appended as Annexure P-5 but a perusal of letter dated 01.05.2023 (Annexure P-6) shows that the same is under consideration, as a result of which, a prejudice is being caused to him. Notice of motion.
Mr. Pankaj Middha, Addl. A.G. Haryana, accepts notice on behalf of respondent-State. He submits that in case, legal notice (Annexure P.5) has not been decided so far by the authority concerned, appropriate speaking order will be passed within a period of eight weeks of receipt of certified copy of this order
CWP No.12932 of 2023 -2and in case, after passing of the speaking order, if the petitioner is found entitled for any relief, the same be granted to him within a period of further four weeks. Keeping in view the statement made by learned State counsel, learned counsel for the petitioner submits that the present petition may be disposed of as having been not pressed any further. Ordered accordingly.
