CHANDIGARH CWP No.11888 of 2015 Date of decision:30.07.2015 Sapna Devi

...Petitioner

Versus

Guru Nanak Dev University, Amritsar and another ...Respondents CORAM: Hon'ble Mr. Justice Rakesh Kumar Jain

Present:

Mr. Ajay Pal Singh Rehan, Advocate, for the petitioner.

***** Rakesh Kumar Jain, J.

The petitioner has prayed for a writ in the nature of mandamus, directing the respondents to provide her a special chance to take the Environmental Studies examination, compulsory for awarding the degree of Bachelor of Arts, and to declare her result of B.A.-II and B.A.-III examination.

During the course of hearing, counsel for the petitioner has admitted that there is no provision in the relevant rules and regulations to provide special chance to a student, therefore, in the absence thereof, mandamus cannot be issued because it can only be issued when the petitioner has a right and the respondent has a corresponding duty to perform.

In view thereof, I do not find any merit in the present writ petition and hence, the same is hereby dismissed. July 30, 2015 (Rakesh Kumar Jain) vinod* Judge
