(Oral) The petitioner has approached this Court seeking issuance of a direction to the official respondents to inquire into the matter pertaining to the allegations as levelled in the representation dated 17.9.2016 Annexure P1 and to proceed against the private respondents. Learned counsel for the petitioner has submitted that the brother of the petitioner had expired on the night intervening 16/17.3.2009 and that his brother's wife by preparing a forged death certificate got the land mutated in his favour.

- 2 - CRM-M-34183-2021 (O&M) I have heard the learned counsel for the petitioner. Since, the factum of death of petitioner's brother is not disputed and nor is the date of death and it is not even the case that any WILL has been executed by the petitioner's brother, therefore, by intestate inheritance it cannot be said that any fraud had been committed by respondent No.4 with the petitioner.
In any case without commenting any further as regards merits of the case, the instant petition is disposed of with liberty to the petitioner to approach the Illaqa Magistrate by way of filing an application under Section 156(3) Cr.P.C. or the Civil Courts in respect of his grievances. The petition stands disposed of accordingly.
