The petition does not contain any particulars whatsoever. Even the memo of appeal has not been filed. The petitioner's only ground for not having complied with the terms and conditions of the allotment letter, namely, failure to carry out construction within the stipulated period, is that his father had fallen ill. The medical certificate is dated 03.12.2014. The medical certificate, however, indicates that the petitioner's father died on 07.02.2008. The possession of the plot was given only thereafter i.e. on 07.04.2008. The record does not indicate that any application for extension of time was made. The respondents repaid the amount due to the petitioner consequent upon the resumption of the plot. The petitioner accepted the same. Subsequently, the petitioner sought to return the amount. The petitioner states that he did so on account of the financial stringency on account of his father's illness. That is possible. However, no particulars in this regard have been furnished.
