The petitioner has approached this Court seeking grant of anticipatory bail in respect of a case registered vide FIR No.13 dated 10.3.2020 at Police Station Aur, District Shaheed Bhagat Singh Nagar under Section 420 Indian Penal Code.

The allegations, in nutshell, are that the petitioner had cheated the complainant of an amount of `8.32 lakhs on the pretext of sending him abroad.

When the instant petition i.e. petition for grant of anticipatory bail was listed before this Court on 23.8.2021 it was expressed that there could be chances PANKAJ KAKKAR 2021.10.05 17:27 I attest to the accuracy and integrity of this document
( 2 ) CRM-M-34199-2021 (O&M) of an amicable settlement. Accordingly, the parties were referred to Mediation and Conciliation Center of this Court, which has yielded results. The matter is stated to have been amicable resolved. The settlement agreement entered before Mediation and Conciliation Center of this Court is also annexed with the file.

Learned counsel for the complainant, who is present in the Court, has submitted that the complainant has received the entire settled amount i.e. amount of `7.5 lakhs and nothing is due. He has further submitted that the complainant has no objection in case the petitioner is granted anticipatory bail.

In view of the aforesaid submission, the petition is accepted and it is ordered that the petitioner, in the event of arrest, be released on bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join investigation as and when called upon to do so and cooperate with the Arresting/Investigating Officer and shall abide by the conditions as provided under Section 438(2) Cr.P.C.
