Prayer made in the present petition is for directing the respondents to reimburse the medical expenses incurred by the petitioner for his treatment. 2.

The petitioner had suffered from heart ailment, for which treatment was taken from Fortis Hospital, Mohali in the year, 2016, whereafter, he had retired on 30.04.2020, after rendering 10 years of service and submitted the claim on 25.01.2017 but the same were returned on the ground that the case comes under cashless scheme, however, it was to be considered in view of the notification dated 05.10.2018. Reference is made to the order passed by this Court on 16.11.2019 in CWP-26220-2018, in case of similarly circumstanced employee, who have thereafter, been granted the benefit as claimed by the petitioner. Learned counsel on instructions stands that the claim of the petitioner be considered taking note of these aforesaid facts, in a time bound manner. 3.

The aforesaid facts having been brought out, during the course of hearing, learned State counsel, on instructions, states that the respondents would MOHIT 2025.03.20 10:35 I attest to the accuracy and integrity of this document

CWP-16313-2021 (O&M) -2not be averse to have a relook at the matter and decide, taking note of the aforesaid submissions, within a period of 4 months, which this Court has no reason to believe the authorities would not address in a just, fair and reasonable manner. 4.

The aforesaid satisfies the learned counsel for the petitioner. 5.

The matter stands disposed of accordingly and if the petitioner is found entitled, grant the benefit forthwith. Needless to say, if the orders are adverse to his interest, the same may be passed after granting opportunity of hearing to him and shall contain reasons, whereupon he shall be free to seek legal redress thereupon.
