***** ARCHANA PURI, J. (Oral) The petitioners have invoked the jurisdiction of the Court under Article 227 of Constitution of India, for issuance of appropriate direction to the Rent Controller, to decide the rent petition No. RP/238/18 titled "Anuradha Sethi & Another v/s M/s Ram & Company and others". It is submitted by learned counsel for the petitioners that the aforesaid rent petition was filed in the year 2018 and is proceeding at snail's pace. It is further submitted that no effective progress has been made in the present case and for this reason, a prayer is made for issuance of direction to the Court concerned for the disposal of the aforesaid rent petition, in a time bound manner.
Status report was called from the concerned Court, vide order dated 02.06.2023, which has been received.
Perusal of the status report reveals that by the present Presiding Officer, the case was dealt by the Court on 02.05.2023 for the first time and thereafter, an application under Order 6 Rule 17 CPC was filed. 2023:PHHC:146749 CR-3531-2023 (O&M) dates, the Court was on leave and further the case was adjourned for 13.07.2023.
On query by the Court, it is submitted that an application was filed by the tenant and the case has since been transferred by the order of learned District Judge. The case is now pending before some other Presiding Officer.
The copies of the zimini orders have also been filed along with the present revision petition. The same have been perused. Considering the same and also considering the volume of work pending in the subordinate Courts, more particularly, a place like Ludhiana, no case is made out for issuance of time bound direction. Hence, the instant revision petition is hereby dismissed.
But anyhow, the Court below to sensitize itself to the instructions issued by this Court from time to time with regard to the expeditious disposal of the cases.
