Daya Chaudhary, J. (Oral) The present writ petition has been filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of certiorari for quashing of order dated 16.07.2014 passed by respondent No.1.

Learned counsel for the petitioner submits that inspite of specific liberty given to the petitioner, the claim of the petitioner has not been considered only on the ground that appeal was dismissed as withdrawn. Learned counsel for the petitioner has also relied upon judgment of Division Bench dated 03.10.2008 passed in CWP NEETU RANI 2015.03.03 09:58 I attest to the accuracy and authenticity of this document Chandigarh

CWP No.1197 of 2015 No.15341 of 2008 wherein it was observed that fresh application be filed along with all relevant documents and the authority was directed to pass a fresh order in accordance with law. Heard arguments of learned counsel for the petitioner and have also perused the impugned order.

No doubt the appeal was dismissed as withdrawn on 26.07.2012 and liberty was given but the same has not been accepted.

Without commenting anything on the merits of the case, the present writ petition is disposed of with a direction that in case, the petitioner appears before the authority along with all relevant documents for renewal, the concerned authority is directed to pass a fresh speaking order in accordance with law within a period of three months from the date of receipt of certified copy of the order. Disposed of accordingly.
