RAMENDRA JAIN, J. (ORAL) Through this application under Section 320(6) Cr.P.C. (CRM-36142-2018), prayer has been made for compounding the offence under Section 138 of the Negotiable Instruments Act, 1881 (for short-'the Act').

Learned counsel for the applicant-petitioner has produced in Court, certified copy of receipt No. 302232 dated 01.09.2018, qua deposit of ` 15,000/- towards 15% cost of the cheque amount, in compliance of the order dated 12.10.2018. The same is taken on record. Office to tag the same at the appropriate place.

Learned counsel for respondent No. 1 submits that she has no objection, if, the petitioner is granted permission to compound the offence as entire claim whatsoever of respondent No. 1 has been satisfied by the RISHU KATARIA 2018.10.29 10:35 I attest to the accuracy and integrity of this document

In view of the above, necessary permission is granted for compounding the offence under Section 138 of the Act. Resultantly, the complaint filed by complainant-respondent No. 1-Sandeep Kumar, is dismissed. The judgment of conviction and order of sentence dated 13.07.2016 of the trial Court as well as that of Ist Appellate Court, dated 11.04.2018, affirming the judgment of trial Court, are set aside. The instant application (CRM-36142-2018) as well as the main revision stand disposed of.
