******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No.72 dated 25.04.2019 registered for offences punishable under Sections 406 and 420 of Indian Penal Code, at Police Station Kamboj, Amritsar Rural, District Amritsar.

Heard.

As per allegations in the FIR, the petitioner had taken money from complainant as well as several other persons to arrange employment for them or for their wards in the Army.

Learned counsel for the petitioner submits that though allegations of payment have been levelled against the petitioner but details of the same are missing and petitioner has been falsely implicated in this case.

CRM-M-26540 of 2019 -2submits that the police has so far recorded statements of 59 persons, who have deposed about making payment to petitioner, who assured employment of their wards in the Army. They have given details about place, where the payments were made and names of witnesses in whose presence those payments were made.

In view of submission of learned State counsel and taking note of gravity of offence, I am of the opinion that custodial interrogation of the petitioner is required in this case. The relief of anticipatory bail is a discretionary relief and no case is made out to exercise the discretionary power of this Court to extend the benefit of anticipatory bail to petitioner at this stage.

Dismissed.
