DEEPAK MANCHANDA, J.(ORAL) This petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No.06 dated 23.8.2023, under Section 153, 153-A, 120-B, 212, 216 IPC, Section 21, 61, 85 NDPS Act and Section 25, 54, 59 Arms Act, Police Station State Special Operation Cell, Mohali.
As per the allegations levelled in the FIR, a secret information was received that one Lakhvir Singh @ Landa resident of Harike, Patti, District Tarntaran, who is now residing in Canada in connivance with Satnam Singh @ Satta resident of Naushera Pannua, District Tarntaran, Gurlal Singh @ Lali resident of village Sarhali Kalan, District Tarntaran alongwith other unknown persons were involved in illegally supplying arms and ammunitions and funding. Further, Lakhvir Singh @ Landa being a follower of Khalistan might disturb the peace in the State of Punjab in the name of religion at the instance of Pakistan Agency ISI and target the SUMIT GULATI 2023.09.14 10:41 I attest to the accuracy and integrity of this document

Learned counsel for the petitioner contends that the present petitioner has been nominated on the disclosure statement of aforesaid persons whereas there is no evidence to link the petitioner with the alleged offence and has been made as a scapegoat due to political rivalry and to ruin the image of the petitioner in the society. Learned counsel submits that the petitioner has been falsely implicated in the present case by the police merely on the basis of suspicion.
On the other hand, learned State counsel on instructions submits that the allegations against the petitioner are serious in nature who is involved in terrorist activities where number of criminal cases have already been registered against him in the State of Punjab. Learned State counsel further submits that and the petitioner is also involved in supplying the arms and ammunitions to the associates of Lakhvir Singh @ Landa, and therefore, his custodial interrogation is required as the investigating agency is taking all steps to find out the persons involved in the conspiracy, funding and harbouring terrorist activities to disturb the peace in the State of Punjab. Since the case is at initial stage and the allegations levelled against the petitioner are serious in nature and the fact that as per the history ticket (Annexure P-3), the petitioner is involved in 15 others FIRs, he does not deserve the concession of anticipatory bail.
