**** HARNARESH SINGH GILL , J. (ORAL) The petitioner is seeking regular bail in FIR No. 63 dated 19.4.2019 registered under Sections 306, 34 IPC at Police Station Gate Hakima, Amritsar, District Amritsar.
Deceased Anuradha was wife of Anmol Singh Sehdav, who is stated to have committed suicide on 19.4.2019. Complainant, namely Sandeep Kumar is brother of the deceased.
Learned counsel for the petitioner contends that petitioner has been in custody since 21.4.2019. The allegation against the petitioner is that she spoke about the character of deceased Anuradha to the brother of the father-in-law of the deceased, namely Rakesh Sehdav, who had a talk about the same with the husband of the deceased. CRM-M No. 26576 of 2019 -2the petitioner has been falsely implicated in this case. It is also submitted that co-accused Anmol Singh Sehdev @ Anmol Sehdev has already been granted regular bail by this Court vide order dated 19.6.2019. On the other hand, learned State counsel has opposed the bail application.
The submission raised by counsel for the petitioner that there are no specific allegations, much less any instigation attributed to the petitioner, which led to commission of suicide by Anuradha, cannot be stated to be without merit.
Petitioner has been in custody since 21.4.2019. Challan has been presented in this case and the trial would take time to conclude. Without commenting anything on the merits lest it should prejudice the case of either side, the petition is allowed and the petitioner is ordered to be released on bail on her furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
