RAJESH BHARDWAJ, J.(ORAL) Instant writ petition has been filed under Article 226/227 of the Constitution of India praying for issuance of a writ in the nature of certiorari for quashing the impugned order dated 17.10.2022, passed by learned Financial Commissioner (Appeals), Punjab, vide which the appeal filed by the petitioner against the order dated 04.09.2019 has been dismissed. It has been contended by counsel for the petitioner that though the case was remanded by respondent No.2 to the District Collector, Hoshiarpur, for fresh decision vide order dated 04.09.2019, however, till date no decision has been taken by the District Collector on the same and the case is pending adjudication. He further submits that village Randhawa Barota is without the post of Lambardar.

Notice of motion to official respondents only at this stage. On asking of the Court, Ms.Akshita Chuahan, DAG, Punjab, who is present in Court, accepts notice on behalf of the official respondents. MEENU 2023.07.05 12:33 I attest to the accuracy and integrity of this order/judgment

CWP-13044-2023 -2However, after arguing for some time, counsel for the petitioner fairly submits that he may be allowed to withdraw this petition with liberty to the petitioner to raise all his grievances before the District Collector before whom the case has been remanded by the Commissioner vide impugned order dated 04.09.2019 for fresh decision. The Court finds the prayer made by counsel for the petitioner is a genuine one.

Hence, the present petition petition is allowed to be withdrawn with liberty to the petitioner to raise all his grievances before the learned District Collector who, after hearing both the sides, would decide the case expeditiously in accordance with law, preferably within six months from the date of receipt of a certified copy of this order. Disposed of.
