CRR No.1806 of 2018, --2-- CRR No.1814 of 2018 and CRR No.1817 of 2018 (O&M) judgments dated 06.07.2017 of the trial court, whereby petitioner was convicted under Section 138 of the Negotiable Instruments Act (for short, "Act") and three separate judgments dated 09.05.2018 of the appellate court, vide which, order of trial court was affirmed. In compliance of order dated 07.01.2019, receipt regarding deposit of 15% of the cheque amount in terms of law laid down in "Damodar S. Prabhu vs. Sayed Babalal H., 2010 (2) RCR (Criminal) 851 has been produced in Court today. The same is taken on record. Be tagged at appropriate place.
As per report received from the ld. Magistrate in compliance to order dated 22.05.2018, the parties have compromised the matter. Therefore, the instant petition as well as other connected petitions are accepted.
The impugned judgment dated 09.05.2018 of the first appellate court and that of trial court dated 06.07.2017 challenged in three revisions titled above are set aside. Criminal complaints bearing Nos.554, 555 and 556 of 2015 are deemed to have been dismissed as withdrawn as having been compromised.
