(Oral) The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking setting aside of order dated 11.04.2019 (Annexure P-8) and order dated 20.02.2023 (Annexure P-15) whereby he has been dismissed from service and his appeal has been dismissed. Mr. Shivoy Dhir, Advocate on 03.07.2023 was asked to get instructions from concerned quarter with respect to benefits which can be paid to petitioner despite dismissal from service. Mr. Dhir, during the course of hearing produced letter dated 08.07.2022 of Commandant. The relevant extracts of the letter read as :- "2.

It is to inform that the following financial benefits may be paid to No.163101569 Ex-SI (GD) Neeraj Kumar ANJU GOEL 2023.07.18 18:44 I attest to the accuracy and integrity of this document

CWP-13157-2023 -22023:PHHC:089889 of this unit. If applied by the petitioner in prescribed format :

a) NPS accumulation b) Leave encashment equal to half of EL due to his leave account.

c) CGEIS saving fund accumulation d) GJSPKK subscription.

Forwarded for your kind information and further communicate to Sh.Shivoy Dhir, Senior Panel Counsel, PB & Haryana High Court for further assist the Hon'ble High Court on 11.07.2023."

On being confronted with aforesaid fact, Mr. Sharma submits that respondents may be directed to decide his application in a time bound manner.

In view of statement of learned counsel for both the parties, the present petition stands disposed of with a direction to the respondents to decide claim of the petitioner within three months from the date of application, if any, filed by the petitioner.
