3. Whether the judgment should be reported in the Digest? --- Surya Kant, J . (Oral) The petitioner is a resident of village Kheri Raiwali, P.S.Dhand, District Kaithal. He alleges that the Gram Panchayat of his village is not taking possession of its land which has been encroached upon by private-respondent Nos.7 to 10 and against whom eviction order was passed way back on 30.06.1986. The petitioner has further averred that the private-respondents filed appeal against the eviction order which was allowed conditionally vide order dated 21.04.1987 to the effect that they were to deposit the cost of the land as assessed by the Competent Authority. However, no such amount has been deposited by them till date, hence the eviction order dated 30.06.1986 has against become operative and attained finality.

CWP No.11210 of 2016 [2] Having heard learned counsel for the petitioner and considering the nature of allegations, however, without expressing any views on merits thereof, as neither the Gram Panchayat nor private-respondents have been heard at this stage, we dispose of this writ petition with a direction to the District Development and Panchayat Officer, Kaithal, to ascertain the correct facts and issue necessary instructions to the Gram Panchayat for taking legal action in accordance with law and principles of natural justice. The needful shall be done within a period of three months from the date of receiving a certified copy of this order.

Ordered accordingly.
