G.S.SANDHAWALIA, J. (Oral) C.M. No. 4059 of 2016 The present application has been filed for withdrawal of the main writ petition with permission to file the case with the Controlling Authority under the Payment of Gratuity Act, 1972 (in short 'the Act'). It has been averred in the application that the payment of arrears of pay fixation has been made by the respondent but the payment of gratuity has not been released in accordance with the provisions of the Act. Accordingly, permission is sought to withdraw the writ petition which stands admitted with liberty to approach the Controlling Authority for the claim of gratuity.

The said request is genuine and is accordingly accepted. CWP No. 21032 of 2011 The writ petition is dismissed as withdrawn with the aforesaid liberty.
