The petitioners have approached this Court challenging order dated 7.3.2020 (Annexure P-9) passed by learned District Judge, Rohtak, whereby the Executing Court has directed the petitioners to seek a clarification from Hon'ble the High Court as regards stay order dated 15.5.2017 (Annexure P3) passed in CWP No.10274 of 2017. 2.

The learned counsel for the petitioners submits that the aforesaid writ petition had been adjourned time and again and is still pending in the Hon'ble High Court, which is presently fixed for 2.11.2020. 3.

The learned counsel for the petitioners has submitted that the aforesaid stay order dated 15.5.2017, till date, has not been vacated and that in these circumstances there was no occasion for directing the petitioners to get a PANKAJ KAKKAR 2020.09.23 19:47 I attest to the accuracy and integrity of this document

( 2 ) CR-2290-2020 (O&M) clarification from the Hon'ble High Court as regards the aforesaid stay order dated 15.5.2017 and that the Executing Court is required to proceed with the matter on the basis of facts and circumstances and the orders as available on record.

The learned counsel for the petitioners submits that he restricts his prayer to delete the directions as issued vide order dated 7.3.2020 (Annexure P-9) passed by learned District Judge, Rohtak to get a clarification from the Hon'ble High Court as regards the aforesaid stay order dated 15.5.2017. 5.

Having heard the learned counsel for the petitioners, the petition is disposed of with a direction that the directions issued by the Executing Court vide order dated 7.3.2020, whereby the petitioners have been directed to get a clarification from the Hon'ble High Court as regards the stay order in question i.e. stay order dated 15.5.2017, shall be deemed to be deleted. 6.

Needless to mention, the Trial Court shall proceed with the matter on the basis of facts and circumstances and the orders as may be available or produced before it by any of the parties.

The petition stands disposed of accordingly.
