The present writ petition has been filed under Articles 226/227 of the Constitution of India averring therein that the petitioner has filed an appeal which is pending before respondent No.2 - Commissioner-cum-Joint Development Commissioner, Appellate Authority, Rural Development and Panchayat - along with an application for stay. 2.
Learned counsel for the petitioner has stated that though the appeal was filed along with the application for stay as far back as 15.07.2022, however, no orders have been passed on the application for stay despite the appeal being a statutory appeal. Learned counsel for the petitioner further states that he limits his prayer in the present petition to the extent that the petitioner would be satisfied if a direction is given to respondent No.2 to decide the application for stay in a time-bound manner and till such time as the application for stay is decided, no coercive action be taken against the AMAN JAIN 2026.05.06 09:14 I attest to the accuracy and integrity of this order/judgment

Mr. Aman Dhir, DAG Punjab accepts notice on behalf of respondents No.1 to 4. Learned counsel for respondents No.1 to 4 is not in a position to deny the fact that the application for stay has not been dealt with by respondent No.2 till date despite the appeal having been filed as far back as 15.07.2022.

In view of the above, the present petition is disposed off with a direction to respondent No.2 - Commissioner-cum-Joint Development Commissioner, Appellate Authority, Rural Development and Panchayat - to decide the application for stay expeditiously and in accordance with law. Till such time, as the application for stay is decided, no coercive action would be taken against the petitioner.
