Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for quashing the order dated 23.02.2017 (Annexure P-6), passed by respondent No.1 - Appellate Authority and the order dated 04.06.2008 (Annexure P-2) passed by respondent No.2. Further prayer has been made to issue direction to respondent No.2 to decide the appeal afresh filed by the petitioner. Further a writ of mandamus has been sought for directing the respondents to reinstate the petitioner in service as Junior Storekeeper from the date of his dismissal on 04.06.2008, with all consequential benefits. 2.

Learned counsel for the petitioner, at the very outset, confines his prayer for deciding the legal notice dated 04.01.2022 (Annexure P-10). Mr. Ranjit Singh Kalra, Advocate, accepts notice on behalf of the respondents and has no objection to the innocuous prayer made by learned counsel for the petitioner.

I have heard learned counsel for the parties and have gone through the record of the case.

Without going into the merits of the case at this stage, the present petition is disposed of with a direction to respondent No.2, to decide the legal notice dated 04.01.2022 (Annexure P-10), expeditiously submitted by the petitioner by passing a speaking order, preferably within a period of 03 months from the date of receipt of certified copy of this order.
